尽管近年来各地相继颁布养犬管理条例，但也只是对养犬登记、养犬行为规范、犬只收容、认定和领养、犬只经营等方面进行了规定，对于犬只伤人，在法律责任方面，几乎都是以罚款的方式进行追责，对刑事责任规定相当模糊。且各地出台的条例属于地方性法规或地方规范性文件，法律位阶较低，不足以对犬只伤人案件中犬只的饲养者或管理者产生震慑作用。
